(1) Notwithstanding anything else written in this Act, a gazetted first class or below civil servant who has been serving in the same category for at least fifteen years will be promoted to one category higher if one month remains before retirement according to section 33.
(2) Notwithstanding anything else written in this Act, if a civil servant in the first grade or below who has been in the same post for at least fifteen years applies for voluntary retirement in accordance with section 35, he shall be promoted to a higher post and retired.
(3) A special post shall automatically be created for promotion in accordance with sub-section (1) or (2) and such post shall automatically be abolished after such civil servant retires from service.
(4) Notwithstanding anything written elsewhere in this section, in case of death of any civil servant who has completed the period under this section in the same position, the family of such employee shall be provided with other benefits including pension of one rank higher.
(5) Notwithstanding anything written elsewhere in this section, if a gazetted first class and gazetted second class civil servant who has been in the same position for at least fifteen years is promoted and wants to retire, such employee will be promoted one grade higher and retired.
